Do you support a proposed York County law that would fine or jail people who ride ATVs on someone's property without permission?

strategically placed on the "trail" through your property might discourage idiot as well.

A trespasser carrying a gun onto your property sounds like an armed intruder to me. Maybe you shoud invoke your 2nd amendment right.

Better yet, I hear that bridge to nowhere is looking for a home. They can build it on your property. Idiot crosses, is never heard from again.

Seriously, good luck with that situation. One of those annoyances in life you shouldn't have to deal with.

What a good idea

I had no idea they existed. If idiot finds it he will destroy it. He has cut trees on my property and used them to build a fence on his lot. I thank you for the idea...are they expensive?

No they are not too expensive, it depends what features you get, but after you are through with it you can sell it to a deer hunter and get your money back. Check Bassproshop.com or cabellas.com or call Nichols store or Carolina sportsman both in Rock Hill. As far as him finding it, you don't have to put it right on the trail, put it back where it is hiden. They come in a camouflaged finish so they don't stand out.

ATV ordinance

Reading about this new proposed ordinance, not law, seems odd in it self. There are already laws that address these issues. They seem to be wanting to pass an ordinance that covers all of this rolled into one. First one being trespassing. Land in SC does not have to be posted in order for an person to be charged with trespassing. It must be a Sheriff Dept. policy not to charge people without it being posted or a warning first. That is not state law. There is also a law against driving through a planted field/food plot etc. and another law that says it is illegal to destroy timber like running over it to create new trail etc. Unless the new ordinance states the suspect MUST pay for any damages,which I doubt it can,the damages could only be recouped in a civil suit. The proposed ordinance also they would like to include motorcycles. Well the trespassing covers everything not just motor vehicles. Either walking,horseback riding, moped, driving anything onto another person's land without permission is illegal. It is illegal to go onto another persons property for any reason whether it be posted or not. If you don't own it or have asked permission you can not go onto the property for any reason even to retrieve downed game that may have run over a property line. You must ask the propery owner first for permission before retrieving your game. I guess in all this would only give the sheriff's dept the right to charge the first time they catch someone instead of worrying about signs and warnings for first offenses. Seems it would be easier to change the Dept. policy about trespassing than to pass a county ordinance to address it. Just let the Dept. charge them like the DNR does. If the landowner is willing to procecute them in court,and I mean signing a statement to that fact,charge the subjects at that time and be done with it. If the Sheriffs dept goes around and started charging everyone they see riding atvs on peoples property without written permission may cause a proplem. The landowner may not want someone charged thinking the subjects might come back for revenge on the landowner wanting to get back at them for charging them. Many landowners are afraid of the riders and what they might do if they charge them. Lots of time they just want the police to tell them to leave and not come back without charging them. This whole thing seems to be a big waste of time and effort when only a minor change to the way the Sheriff Dept. handles these calls would solve the whole thing. As far as parents being held responsible for their kids with ATVs here is what seems to work best. When their kid is caught either in the highway or on someones elses property on an atv call a wrecker to tow the atv back to their house while the police escourt the juvenile home and tell the parents where they were and what they were doing and if it happens again they will have to pay another tow bill. After the parents get tired of having to pay for getting the atv towed they will keep their kids in the yard or on their own property.

As a landowner

close enough in to be the only place around for the dirt bikes and atv's...I can say THANK GOD! It is about time. I have had more trouble with one idiotic adult on a motorcycle than it is worth. this idiot would tresspass and when I would call him he would say: Prove it. Call the cops? They say, Prove it. So he would lie and it became a game.

He hasn't been back because of my repeated calls to officials...this jerk even was shooting a rifle at night...found out he had put out bait for deer...what a jerk. OK, I say if you don't own the land and haven't gotten permission then keep off of it. Too bad most people don't think like me and have to be made to do what is right.

You should purchase a game trail camera. Strap it to a tree and turn it on, whenever anything passes in front of it it snaps a picture, silently, and at night it uses an infrared flash that cannot be seen. Then you download your picture with the time and date printed on it.
